These Terms of Service ("Terms") govern your access to and use of the UnlockDM platform operated by Eightinity("we", "us", "our"). By creating an account or using our service, you agree to be bound by these Terms.

1. Description of Service

UnlockDM is a campaign management platform that enables Instagram creators to run keyword-triggered, follow-gated DM campaigns. The platform automates comment detection, follow verification, reward delivery via direct message, and referral tracking using the Meta Graph API.

2. Eligibility

To use UnlockDM you must:

Be at least 18 years old.
Have a valid Instagram Business or Creator Account.
Have the legal authority to bind yourself or your organisation to these Terms.
Not be prohibited from using the service under applicable laws.

3. Meta Platform Compliance

UnlockDM operates through the Meta Graph API. By using our service, you agree to comply with Meta's platform policies at all times, including:

You are solely responsible for ensuring your campaigns comply with Meta's policies. We reserve the right to suspend your account if your campaigns violate Meta's terms or put our API access at risk.

Important: UnlockDM uses the 24-hour messaging window enforced by the Instagram Messaging API. You may only send DMs to users who have interacted with your content within the last 24 hours. Campaigns must not be used to send unsolicited messages.

4. Account Responsibilities

You are responsible for:

Maintaining the confidentiality of your account credentials.
All activity that occurs under your account.
Notifying us immediately at hello@tryunlockdm.com if you suspect unauthorised access.
Ensuring your Instagram account remains in good standing with Meta.

5. Acceptable Use

You may use UnlockDM only for lawful purposes. You must not:

Use the platform to send spam, phishing messages, or misleading content.
Offer illegal products, services, or rewards through your campaigns.
Use fake, purchased, or bot accounts to inflate campaign metrics.
Attempt to reverse-engineer, scrape, or exploit the platform.
Interfere with the security, integrity, or availability of the service.
Use the platform in a way that violates the rights of any third party, including intellectual property rights and privacy rights.
Circumvent or attempt to circumvent Meta's rate limits or API restrictions.

6. Participant Data and Creator Responsibility

When you run a campaign, UnlockDM collects data about your Instagram followers who interact with your Reel (commenters, referred users). You, as the campaign creator, are the data controller for this participant data. You are responsible for:

Disclosing to your audience how their data will be used (e.g., in your Reel caption or story).
Ensuring your use of participant data complies with applicable privacy laws.
Not using referral or participant data for purposes outside the stated campaign.

7. Intellectual Property

UnlockDM and all content on the platform (excluding content you create) is owned byEightinity or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform solely for its intended purpose.

You retain ownership of all campaign content, reward materials, and DM templates you create. By using the platform, you grant us a limited licence to process and transmit this content solely to operate your campaigns.

8. Subscription, Billing, and Cancellation

Access to UnlockDM may be subject to subscription fees. Pricing is displayed on our pricing page and is subject to change with 30 days' notice. Fees are non-refundable except where required by law or at our sole discretion.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any of the following:

Violation of these Terms or Meta's platform policies.
Fraudulent, abusive, or harmful use of the platform.
Inactivity for an extended period.

Upon termination, your right to access the platform ceases immediately. You may request an export of your campaign data within 30 days of termination.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS FROM USING THE SERVICE WILL MEET YOUR REQUIREMENTS.

We do not guarantee that your campaigns will achieve any specific follower growth, referral count, or business outcome. Results depend on your content, audience, and Instagram's algorithm.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EIGHTINITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of India.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice on the platform at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
